Terms and Condtions

Last updated: July 29, 2026

These Terms and Conditions (“Terms”) govern access to and use of mooiequinebalm.ca and purchases from Mooi Equine Balm ("the business" “we,” “us,” or “our”). By using the website or submitting an order, you agree to these Terms. If you do not agree, do not use the website or place an order.

1. Eligibility and Authority

You must have reached the age of majority in your province, territory, state, or country and have legal capacity to enter into a contract. If you purchase on behalf of a business, stable, organization, or another person, you represent that you have authority to bind them.

2. Product Information and Intended Use

We aim to describe and display our products accurately. Packaging, colour, texture, scent, ingredients, weight, and appearance may vary slightly between batches or screens. Product images are illustrative, and we may update packaging or product information without notice.

Mooi Equine Balm is intended only for the uses stated on its current label and product page. Read and follow all directions, warnings, ingredient information, storage instructions, and expiry or lot information before use. Do not use the product for a purpose, species, body area, or condition not identified in the directions.

3. Animal Health Disclaimer

Website content, testimonials, educational materials, and customer-service communications are general information only and are not veterinary advice, diagnosis, or treatment. They are not a substitute for advice from a qualified veterinarian who has examined the animal. Results vary, and we do not guarantee a particular outcome.

Before use, review the ingredients and consult a veterinarian if the horse is pregnant, nursing, very young, medically vulnerable, using medication, has allergies or broken skin, or is being treated for a condition. Stop use and seek veterinary advice if irritation, sensitivity, worsening symptoms, or another unexpected reaction occurs. In an emergency, contact a veterinarian or animal poison resource promptly.

If the horse competes under medication-control or prohibited-substance rules, the purchaser is responsible for confirming every ingredient and required withdrawal period with the applicable governing body and veterinarian before use.

4. Orders and Acceptance

Your checkout submission is an offer to purchase. An automated acknowledgement does not necessarily mean we have accepted the order. We may decline or cancel an order before shipment because of inventory errors, pricing or description errors, suspected fraud, payment issues, shipping restrictions, safety concerns, quantity limits, or other reasonable business reasons. If we cancel after payment, we will refund the cancelled amount to the original payment method.

Please review your cart, email, shipping address, and delivery service carefully before submitting an order. Contact us immediately using our contact form if you notice an error. We cannot guarantee changes after fulfilment has begun.

5. Prices, Taxes, and Payment

Prices are shown in CAD unless stated otherwise and may change without notice. Applicable taxes and shipping charges are displayed at checkout. You authorize the payment provider to charge the total shown when you submit your order. Promotions, discount codes, and gift cards are subject to their stated conditions and may not be combined unless we say otherwise.

Obvious pricing or calculation errors may be corrected. If a correction materially changes an unshipped order, we will contact you and give you the choice to accept the corrected total or cancel for a refund.

6. Shipping, Delivery, and Returns

Our Shipping Policy forms part of these Terms. Shipping charges are calculated at checkout using available carrier rates and the order’s destination and parcel details. Delivery windows shown at checkout or in tracking are estimates unless expressly identified as guaranteed.

Our cancellation, return, exchange, and refund rules are in our Shipping / Return Policy. Nothing in these Terms limits rights or remedies that cannot legally be excluded, including remedies for defective, unsafe, misdescribed, or otherwise non-compliant goods.

7. Accounts

You are responsible for providing accurate account information, safeguarding login credentials, and notifying us of suspected unauthorized access. We may suspend or close accounts used unlawfully, fraudulently, or in violation of these Terms.

8. Acceptable Use

You may not misuse the website, interfere with its security or operation, introduce malicious code, scrape or copy content without authorization, impersonate another person, submit false information, violate another person’s rights, or use the website for unlawful, fraudulent, or harmful activity.

9. Intellectual Property

The website and its content—including the business name, logos, product names, copy, graphics, photographs, videos, design, and other materials—are owned by or licensed to us and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the website for personal or internal business purchasing. No other rights are granted.

10. Reviews and User Content

If you submit a review, photo, testimonial, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content for operating and promoting Mooi, subject to applicable privacy law. We may moderate or remove content, but are not required to do so.

11. Third-Party Services

The website relies on third parties, including Wix, payment providers, Shippo, Clickship, and shipping carriers. Their services may be subject to separate terms and may occasionally be unavailable. Links to third-party sites are provided for convenience and do not imply endorsement.

12. Disclaimers

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free access, that all content is complete or current, or that a product will produce a particular result. Any warranties or conditions that cannot legally be excluded remain in effect.

13. Limitation of Liability

To the fullest extent permitted by applicable law, the business and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity arising from the website, an order, product use contrary to directions, or third-party services.

Where liability may lawfully be limited, our total liability relating to a claim will not exceed the amount you paid to the business for the product or order giving rise to the claim. These limits do not apply to fraud, wilful misconduct, gross negligence where it cannot be excluded, death or personal injury caused by negligence, breach of non-waivable consumer rights, or any other liability that law does not permit us to exclude or limit.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold the business harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the website, your material breach of these Terms, your infringement of another person’s rights, or your use of a product contrary to its directions or warnings. This section does not apply to the extent a claim results from our own breach, negligence, or misconduct.

15. Changes, Suspension, and Termination

We may modify or discontinue website features and may update these Terms. Revised Terms apply from the date posted and do not retroactively change an accepted order unless required by law or agreed with you. We may suspend access for a material breach, fraud, security risk, or unlawful activity.

16. Governing Law and Disputes

These Terms are governed by the laws of ALBERTA and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, the courts located in ALBERTA will have jurisdiction. If you are a consumer, this clause does not deprive you of protections or forums that cannot legally be waived in your home jurisdiction.

17. General

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, Shipping Policy, Return/Refund Policy, and any order-specific terms form the entire agreement concerning the website and purchases.
